2. Definitions

• Company: ArtFlame, operated by ArtFlame.
• Website: https://artflame.ai and related ArtFlame pages, dashboards, apps, APIs, and tools.
• User: Any individual or entity that accesses ArtFlame as a visitor, account holder, subscriber, customer, or creator.
• Products: Digital software access, AI image tools, AI video tools, templates, workflows, credits, subscriptions, and other digital resources.
• Product Material: All content, prompts, models, examples, templates, documentation, training materials, and digital resources provided through ArtFlame.
• Learning Platform or Creative Platform: The online environment where Products are accessed and creative activity occurs.

3. Account Creation and User Responsibility

Account Registration

By creating an account, purchasing a Product, or using paid features, you agree to provide accurate, current, and complete information and to update it when necessary.

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. Any activity under your account will be considered your responsibility.

Notice of Compromise

If you believe your account information has been compromised, notify us immediately at support@artflame.ai.

Age Requirement

You must be at least 18 years old to use ArtFlame. If you use ArtFlame on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Website, App, and Product Access

By using or purchasing our Products, you acknowledge that you are granted digital access to our creative software, AI tools, workflows, templates, and related resources.

Subscriptions, annual plans, credit packages, upgrades, limited-time promotions, and upsell offers may be presented during checkout, all subject to these Terms.

The exact price, renewal interval, credit allocation, plan features, and cancellation method displayed and confirmed at checkout apply to your purchase.

5. Plans, Offers, and Enrollment Terms

ArtFlame offers may include monthly and annual subscription plans, free trials, paid trials, one-time credit packs, limited promotional pricing, and optional upgrades.

Promotional tests, discounts, or limited-time offers may display different pricing at checkout. The price displayed and confirmed at checkout controls your purchase or renewal.

Free Trial to Paid Subscription Disclosure

If a free trial, discounted trial, or promotional period is offered, the checkout page will display the trial length, initial price, renewal price, renewal date, and cancellation method before purchase. Unless canceled before the trial or promotional period ends, the subscription will renew at the price disclosed at checkout.

6. Software Access, Subscription Plans, and Credits

ArtFlame provides access to proprietary and third-party-powered software features as part of its Products and services. Access is granted as a limited, revocable, non-exclusive, non-transferable license.

Credits System

The platform uses a credit-based system for certain features, generations, edits, uploads, model calls, video seconds, premium workflows, and processing tasks.

• Credits are non-refundable, non-transferable, and non-exchangeable for cash or monetary value.
• Once credits are used, they cannot be restored except where ArtFlame chooses to refund failed or canceled generations.
• Subscription credits may reset, expire, or become unavailable after the billing cycle, cancellation, downgrade, or termination.
• Credit pricing may vary by model, duration, resolution, feature, provider cost, or operational constraints.
• ArtFlame may modify credit allocations, credit costs, plan structures, model access, or feature availability at any time.

7. Billing, Auto-Renewal, Cancellation, and Refunds

Billing and Auto-Renewal

All subscription plans automatically renew at the end of each billing cycle unless canceled before renewal. By subscribing, you authorize ArtFlame or its payment processor to charge your payment method on a recurring basis according to your selected plan.

Cancellation

To cancel your subscription, use your account billing settings, visit the pricing or billing page, or contact support@artflame.ai with the subject "Cancel My Subscription." Your subscription will generally remain active through the remainder of the paid billing period.

No Refund Policy for Software and Credits

All purchases related to subscription plans, credits, software access, digital tools, digital features, and usage are final and non-refundable except where required by law or expressly stated by ArtFlame.

• No refunds, partial refunds, or credits will be issued for unused credits.
• No refunds, partial refunds, or credits will be issued for partially used billing periods.
• No refunds, partial refunds, or credits will be issued for failure to cancel before renewal.
• No refunds, partial refunds, or credits will be issued for dissatisfaction with features, results, model behavior, generation quality, or provider availability.

Payment Authorization and Reprocessing

By completing a purchase, you authorize payment for the selected product or service. If an initial payment attempt is declined, you authorize reattempts for the same order or subscription where permitted by law and payment processor rules.

8. Generated Content, Ownership, and AI Output

Generated Outputs

ArtFlame does not claim ownership of images, videos, audio, text, or other creative outputs you generate through the Services. Subject to these Terms, applicable law, third-party model terms, and your subscription level, you may use outputs you generate for personal or commercial purposes.

No Guarantee of Output

AI output may be unpredictable and may not match your prompts, references, likeness requests, text placement, quality expectations, or creative goals. You are solely responsible for reviewing outputs and ensuring your use complies with applicable law and third-party rights.

Third-Party Model Terms

Some features depend on third-party AI models, APIs, or providers. Your rights to use outputs may be affected by those providers' rules, availability, safety systems, and commercial-use terms.

9. User Content and Prohibited Uses

You are responsible for prompts, uploads, references, images, videos, files, profile information, comments, support messages, and other content you provide through ArtFlame.

• You may not use ArtFlame for illegal activity, fraud, harassment, impersonation, spam, malware, or deceptive conduct.
• You may not upload or request content that infringes intellectual property, privacy, publicity, or other rights.
• You may not generate or distribute sexual exploitation, non-consensual intimate content, hateful content, threats, instructions for wrongdoing, or content that promotes violence or self-harm.
• You may not scrape, overload, reverse engineer, bypass moderation, evade credits or billing, share credentials, abuse free trials, or interfere with the platform.
• You may not use proprietary ArtFlame workflows, templates, prompts, methods, or training materials to build a directly competing service without permission.

10. Intellectual Property Rights

All content, designs, trademarks, logos, software, workflows, interfaces, code, documentation, templates, and materials on ArtFlame are owned by ArtFlame or its licensors, except for User Content and generated outputs as described in these Terms.

Upon purchasing or accessing a Product, you receive a limited, non-exclusive, non-transferable license to use the Product for permitted purposes. No part of ArtFlame Product Material may be reproduced, distributed, modified, transmitted, sold, or made available without prior written consent unless the feature expressly allows it.

We respect intellectual property rights. Copyright or infringement notices may be sent to support@artflame.ai with enough information for us to identify and evaluate the allegedly infringing material.

11. Electronic Communications and Privacy

By using ArtFlame, you consent to receive electronic communications from us, including account notices, product updates, billing notices, security notices, support messages, and promotional materials.

Marketing emails may include an unsubscribe option. Opting out of promotional communications may not stop important service, billing, security, or legal notices.

12. Third-Party Services and Payment Processing

ArtFlame may use third-party providers for authentication, hosting, storage, analytics, AI models, moderation, email, support, payment processing, and infrastructure.

Payments may be processed by Stripe or other payment processors. Your payment information is handled by those processors according to their own terms and privacy policies. ArtFlame does not store full payment card numbers on its own servers.

Third-party services may change, fail, become unavailable, impose rate limits, reject content, change pricing, or modify terms. ArtFlame is not responsible for third-party services that we do not control.

13. Disclaimers, Liability, and No Guarantee of Results

ArtFlame Products and services are provided "as is" and "as available" without warranties of any kind, either express or implied, to the maximum extent permitted by law.

We do not guarantee uninterrupted access, error-free operation, exact generation results, specific creative outcomes, professional success, financial results, audience growth, sales, revenue, or fitness for a particular purpose.

To the fullest extent permitted by law, ArtFlame will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost goodwill, business interruption, or costs of substitute services. ArtFlame's total liability will not exceed the greater of $100 or the amount you paid to ArtFlame in the 12 months before the claim.

14. Fraud Prevention, Suspension, and Termination

To protect the platform and users, we may request identity verification or additional review for suspicious transactions, chargebacks, failed payments, abuse patterns, account sharing, policy violations, or security concerns.

Accounts involved in fraudulent activity, payment disputes, multiple failed payment attempts, abusive generation behavior, or violations of these Terms may be suspended or terminated immediately without notice.

Upon termination, your right to access ArtFlame ends immediately. You may lose access to credits, subscriptions, libraries, generated content, uploads, account data, and other services except where retention or access is required by law.

15. Governing Law and General Terms

Modifications to Terms

We may modify these Terms at any time. Changes will be posted with an updated effective date. Continued use of ArtFlame after such changes constitutes acceptance of the modified Terms.

Compliance with Consumer Protection Laws

These policies are intended to comply with applicable consumer protection laws. If a required law conflicts with these Terms, the applicable law will control only to the extent of the conflict.

Force Majeure

ArtFlame is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, government action, internet outages, provider outages, labor issues, cyberattacks, or other unforeseen events.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented for specific features, constitute the entire agreement between you and ArtFlame regarding the Services.
